TERMS OF USE

Last Updated: September 5, 2026

These Terms of Use (“Terms”) govern your access to and use of commercialpointcommunitymensclub.org (the “Website”), operated by Commercial Point Community Men's Club Foundation (“Commercial Point Community Men's Club,” “the Club,” “we,” “us,” or “our”).

By accessing or using the Website, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Website.

1. USE OF THE WEBSITE

The Website provides information about the Club, community events, programs, membership opportunities, facility rentals, fundraising activities, and other community initiatives.

You may use the Website for lawful, personal, and informational purposes and to interact with services and features we make available.

You agree not to use the Website in any manner that violates applicable law, interferes with Website operation, infringes the rights of others, or is otherwise unauthorized or harmful.

2. CLUB INFORMATION AND ACTIVITIES

The Club may use the Website to provide information regarding meetings, events, community programs, fundraisers, membership, scholarships, youth activities, facility rentals, and other Club or community activities.

Information regarding these activities may change from time to time. We reserve the right to modify, postpone, cancel, limit, or discontinue activities, programs, events, or Website offerings when reasonably necessary.

3. MEMBERSHIP

Information regarding Club membership may be provided through the Website.

Membership eligibility, dues, responsibilities, voting rights, participation requirements, and other membership matters may be governed by separate Club bylaws, rules, policies, or other governing documents.

Nothing on the Website modifies or replaces the Club's applicable governing documents.

4. FACILITY RENTALS AND RESERVATIONS

The Website may allow users to inquire about, reserve, or pay for use of Club facilities, including the Club building or shelter.

Availability displayed through the Website is subject to confirmation and may change.

Rentals may be subject to additional rules, restrictions, fees, deposits, cancellation requirements, cleanup requirements, occupancy limits, or other conditions communicated during the reservation process or through a separate rental agreement.

By completing a rental or reservation, you agree to comply with all applicable rental requirements provided by the Club.

If a separate rental agreement or policy conflicts with these general Website Terms regarding a specific rental, the terms of the applicable rental agreement or policy will control for that rental.

5. PAYMENTS AND FEES

Certain Website activities, including facility rentals, event registrations, membership-related transactions, or other Club activities, may require payment.

You agree to provide accurate and complete information when completing a transaction.

Payments may be processed through Wix or another third-party payment processor. Your transaction may therefore also be subject to the applicable provider's terms and privacy practices.

The Club reserves the right to correct pricing or transaction errors where reasonably necessary.

6. CANCELLATIONS AND REFUNDS

Cancellation, refund, rescheduling, and deposit policies may vary depending on the applicable rental, event, program, or transaction.

Any specific cancellation or refund terms communicated at the time of registration, reservation, or purchase will apply to that transaction.

Unless otherwise stated, submitting payment does not create a right to a refund beyond the refund or cancellation terms applicable to the particular transaction.

7. EVENTS AND PROGRAMS

Participation in Club events, programs, fundraisers, or community activities may be subject to additional eligibility requirements, rules, waivers, releases, registration terms, or participation requirements.

The Club may make reasonable changes to event dates, times, locations, programming, capacity, or other details.

Where separate terms or participation documents apply to a particular activity, those documents will control with respect to that activity.

8. YOUTH PROGRAMS AND ACTIVITIES

The Club may support, sponsor, promote, or provide information regarding youth programs, scholarships, community activities, or other opportunities involving minors.

Participation in activities involving minors may require authorization from a parent or legal guardian and may be subject to separate rules, applications, releases, or eligibility requirements.

Information appearing on the general Website does not replace any required parental consent, program documentation, or participation agreement.

9. PHOTOGRAPHS, VIDEO, AND EVENT CONTENT

The Website may feature photographs, videos, or other media from Club events, programs, community activities, or facilities.

The Club seeks to use such materials in accordance with applicable permissions and legal requirements.

If you have a concern regarding a photograph, video, or other content displayed on the Website, please contact the Club using the information provided below.

10. WEBSITE CONTENT

We make reasonable efforts to provide useful and accurate information through the Website. However, event details, dates, prices, availability, program information, membership information, and other Website content may change.

We do not guarantee that all Website information will always be complete, current, or error-free.

We reserve the right to correct errors and update Website content at any time.

11. INTELLECTUAL PROPERTY

Unless otherwise indicated, Website content owned by the Club, including text, graphics, logos, photographs, videos, documents, and other original materials, is protected by applicable intellectual property laws.

You may access and use Website content for personal and non-commercial purposes.

You may not reproduce, distribute, modify, publish, sell, commercially exploit, or otherwise use Club-owned Website content without permission, except as permitted by law.

Third-party names, logos, photographs, or other materials remain the property of their respective owners.

12. USER SUBMISSIONS

If you submit information through the Website, including through contact forms, registration forms, rental inquiries, or other interactive features, you agree to provide information that is accurate and lawful.

You may not submit content that:

  • Is fraudulent, misleading, threatening, defamatory, obscene, or unlawful;

  • Infringes another person's intellectual property or privacy rights;

  • Contains malicious software, viruses, or harmful code;

  • Attempts to interfere with Website security or operation; or

  • Is otherwise inappropriate for the purpose of the Website feature being used.

13. THIRD-PARTY SERVICES AND LINKS

The Website may use or link to third-party services, including payment processors, social media platforms, mapping services, analytics providers, or other external websites and technologies.

The Club does not control independent third-party services and is not responsible for their content, availability, security, privacy practices, or terms.

Your interactions with third-party services are governed by the terms and policies of those providers.

14. PRIVACY

Your use of the Website is also subject to our Privacy Policy, which describes how information may be collected, used, and disclosed through the Website.

Please review the Privacy Policy before submitting personal information.

  • Use the Website in a way that could damage, disable, overburden, or impair its operation.

16. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Website and its content are provided on an “AS IS” and “AS AVAILABLE” basis.

The Club does not warrant that the Website will always be uninterrupted, secure, error-free, or free from harmful components, or that all Website information will always be complete or current.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

17. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Commercial Point Community Men's Club Foundation and its officers, directors, volunteers, representatives, and service providers will not be liable for indirect, incidental, special, consequential, or similar damages arising solely from your access to or use of, or inability to use, the Website.

Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited.

Additional agreements, releases, or rules applicable to specific events, rentals, or programs may contain separate provisions governing those activities.

18. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Commercial Point Community Men's Club Foundation and its officers, directors, volunteers, and representatives from claims, liabilities, damages, losses, or expenses arising from your unlawful misuse of the Website, your violation of these Terms, or your infringement of another person's rights.

19. GOVERNING LAW

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.

Any dispute relating to these Terms or use of the Website will be subject to applicable law and the jurisdiction of courts having authority over the matter.

20. CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes to the Website, Club activities, services, policies, or applicable requirements.

When changes are made, the “Last Updated” date at the top of this page will be revised.

Your continued use of the Website after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

21. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

22. NO WAIVER

The Club's failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

23. ENTIRE AGREEMENT

These Terms and the Privacy Policy constitute the general terms governing use of the Website.

They do not replace separate agreements, bylaws, rental agreements, event rules, releases, applications, membership requirements, or other documents that may apply to specific Club activities.

Where a separate agreement applies to a specific transaction, rental, event, program, or activity, that agreement will control with respect to that matter.
